Functionally, religion is what is held as sacred, that is, as untouchable. In the United States, taxes and military manpower are untouchable and, therefore, beyond objection by particular religions. The courts, too, are untouchable in determining what is and what is not religion. Despite these severe limitations on religious freedom, sometimes religion has broken the national consensus - most notably in the abolitionist movement of 1829-1865 and in the civil rights movement of 1959-1964. Consider a familiar case. A sign reads, “No vehicles in the park.” A man in the park has a heart attack. An ambulance is needed. Does its entry violate the rule? Most people would say that the rule was not meant to apply to needed ambulances. It would not make any difference if the rule read, “No vehicles whatsoever in the park.” The purpose of any rule against vehicles would not be served by a flat prohibition of ambulances. Consider a (...) second case. A child comes to the park on a tricycle. Is he barred from entering? A tricycle is a vehicle. But is it the kind of vehicle the author of the sign had in mind? He may only have wanted to preserve the park from fast or noisy vehicles. The purpose of the rule again becomes crucial. Is the purpose to maintain quiet and security, or is the purpose to assure absolute tranquility? The prohibition of the tricycle will depend on what purpose is accepted. (shrink)

Born in Granada, April 30, 1901, Antonio De Luna was educated in the universities of Granada and of Madrid, continued his studies at Freiburg in Bresgovia, Paris, and Oxford and received the doctorate in law from Bologna. At the age of 27 he was appointed to the chair of natural law at the University of La Laguna in the Canary Isles, and from there went on to Salamanca and Granada. In 1932 he obtained the chair of international public law of (...) the Faculty of Law of the University of Madrid. At this time he began a period of intense professional activity: He was Secretary of the Federation of Spanish Associations of International Studies (1932–1936), founder and director of the Institute of International and Economic Studies (1932–1936), and Secretary of the Juridical Assessory Commission of the Spanish Republic (1931–1934). Potts Jr. (bio)In December 1997, the Institute of Medicine (IOM) released a report on medical and ethical issues in the procurement of non-heart-beating organ donors. This report had been requested in May 1997 by the Department of Health and Human Services (DHHS). We will here describe the genesis of the (...) IOM report, the medical and moral concerns that led the DHHS to sponsor it, the process of producing it, and its conclusions. The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. NHBDs can be “controlled,” which means that [End Page 83] they can be sustained by artificial life support systems until a medical and family decision is made to terminate futile life support. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. NHBDs can also be “uncontrolled,” which means that their hearts and breathing have stopped through disease or injury at an unexpected time or in an uncontrolled manner, and they cannot be resuscitated; the organs of some individuals of this description can be recovered for transplantation. Material acquisition—buying, inheriting, being given—and nonmaterial—learning a word, assimilating a form—have been likened, and in both, meaningful acquisition cannot take place without a taxonomy, a scheme of categories into which the acquired element can be fitted. Then with these elements—both material and nonmaterial—we create a world or build and project a self, the painter and the interior decorator equally manipulating the elements in a vocabulary. The coarseness of such an outlook seems to bludgeon away long-established fine distinctions. We need not (...) deny, however, that there may be a kind of "indifference" in regard to "the real existence of the thing" which allows us "to play the part of judge in matters of taste," as Kant would have it,1 we need not deny the existence of an "aesthetic attitude: it is just that such indifference and such an attitude probably don't have much to do with our day-to-day experience of artifacts and perhaps needn't. The "aesthetic attitude" was not long ago defined by Jerome Stolnitz as "disinterested and sympathetic attention to and contemplation of any object of awareness whatever, for its own sake alone."2 Stolnitz is at pains to distinguish the aesthetic attitude from "interests" with which it may be preferable to confuse it. "One of them," he writes, "is the interest in owning a work of art for the sake of pride or prestige". FRANCIS HERBERTBRADLEY (1846-1924) 1 agreed with the other English idealists that the real world is the experienced world. But he started with the fundamental conviction that "experience" is more than "thought," as Green had maintained. Bradley's basic drive is the refusal to abolish "feeling" in favor of knowledge and intelligibility. "Feeling" is a fundamental and (...) ineradicable aspect of "reality"m more fundamental, in fact, than thinking. In the immediately experienced world, all intelligible distinctions and relations are merged in a "whole of feeling" which is the ultimate subject-matter of philosophy. "Thought" arises out of feeling, out of "immediacy," as an interpretation of immediate experience by distinguishing relations and aspects in it. "Knowledge " is only one aspect of the experienced world; it needs blending with "feeling" and will to include all the experienced aspects. "Feeling" starts for Bradley, in his Principles of Logic (1883), in pretty much the empiricist sense, as isolated sensations, and as subjective (in flavor at least). It then becomes neutral: "feeling" is identified with "the felt"; and it grows richer, attempting to include the whole wealth of immediate experience. Thus Bradley gets very close to Dewey's conception of "direct experience," "non-reflective experience," without, however, Dewey's biological analysis. It is through this conception of experience that Bradley approaches the naturalism to which his thinking almost arrived at the end. Thought, that is, has a setting in experience " it is relational, and by its analysis it breaks up experienced and felt wholes. There is a double insistence in Bradley. On the one hand, reality is experienced, but is not adequately expressed in thought. On the other, reality/s accessible to knowledge. The real, experienced world is never identical with the intelligible world, yet it is also never "extraneous " to it. The relation of the two can be said to be, in Aristotelian terms, that of substance to form, that of what is to its intelligible aspect. The intelligible world, the system of science and knowledge, thus fundamentally needs criticism in the light of its setting in the experienced world. This is not only the entire drive of Dewey's Experience and Nature; it is the expression of that whole current of thought on the Continent which began with the criticism of Hegel's "panlogism" in the 1840's and is today called "Existentialism." In many ways, his story contributes a large portion to the founding of the AAPP, this journal, and the philosophy/psychiatry community worldwide.I met Professor Wiggins as a sophomore at Southern Methodist University in Dallas in 1974. I was a student in his twentieth-century humanities class. I try in this essay to accomplish two things. First I offer some first thoughts toward a clarification of the ethical foundations of private property rights that avoids pitfalls common to more strictly Lockean theories, and is thus better prepared to address arguments posed by critics of standard private property arrangements. Second, I'll address one critical argument that has become pretty common over the years. While versions of the argument can be traced back at least to Pierre Joseph Proudhon, I'll (...) focus on a formulation given it by Jeremy Waldron. The basic idea is that the only sound arguments for private property rights lead to the conclusion that society has an obligation to insure that every citizen possess private property. In Waldron's formulation, what is justifiable is a general, rather than a special, right to private property. I shall try to suggest that this conclusion is unwarranted. (shrink)

Hrushovski originated the study of “flat” stable structures in constructing a new strongly minimal set and a stable 0-categorical pseudoplane. We exhibit a set of axioms which for collections of finite structure with dimension function δ give rise to stable generic models. In addition to the Hrushovski examples, this formalization includes Baldwin's almost strongly minimal non-Desarguesian projective plane and several others. We develop the new case where finite sets may have infinite closures with respect to the dimension function δ. In (...) particular, the generic structure need not be ω-saturated and so the argument for stability is significantly more complicated. We give a general account of the goals of axiomatization, introducing a variant on Detlefsen’s notion of ‘complete descriptive axiomatization’. We describe how distinctions between the Greek and modern view of number, magnitude, and proportion impact the interpretation of Hilbert’s axiomatization of geometry. We argue, as did Hilbert, that Euclid’s propositions concerning polygons, area, and similar triangles are derivable from Hilbert’s first-order axioms. We argue that Hilbert’s axioms including continuity show much more than the geometrical propositions of Euclid’s theorems and (...) thus are an immodest complete descriptive axiomatization of that subject. We explore Shelah's model‐theoretic dividing line methodology. In particular, we discuss how problems in model theory motivated new techniques in model theory, for example classifying theories by their potential (consistently with Zermelo–Fraenkel set theory with the axiom of choice (ZFC)) spectrum of cardinals in which there is a universal model. Two other examples are the study (with Malliaris) of the Keisler order leading to a new ZFC result on cardinal invariants and attempts to clarify the “main gap” by reducing the (...) dependence of certain versions on (highly independent) cardinal arithmetic. In this paper we study abstract elementary classes of modules. We give several characterizations of when the class of modules A with is abstract elementary class with respect to the notion that M1 is a strong submodel M2 if the quotient remains in the given class.

We study when classes can have the disjoint amalgamation property for a proper initial segment of cardinals. Theorem A For every natural number k, there is a class $K_k $ defined by a sentence in $L_{\omega 1.\omega } $ that has no models of cardinality greater than $ \supset _{k - 1} $ , but $K_k $ has the disjoint amalgamation property on models of cardinality less than or equal to $\mathfrak{N}_{k - 3} $ and has models of cardinality $\mathfrak{N}_{k (...) - 1} $ . More strongly, we can have disjoint amalgamation up to $\mathfrak{N}_\alpha $ for α > ω, but have a bound on size of models. Theorem B For every countable ordinal a, there is a class $K_\alpha $ defined by a sentence in $L_{\omega 1.\omega } $ that has no models of cardinality greater than $ \supset _{\omega 1} $ , but K does have the disjoint amalgamation property on models of cardinality less than or equal to $\mathfrak{N}_\alpha $ . Finally we show that we can extend the $\mathfrak{N}_\alpha $ to $ \supset _\alpha $ in the second theorem consistently with ZFC and while having $\mathfrak{N}_i \ll \supset _i $ for 0 > i < α. We prove two results on the stability spectrum for Lω1,ω. Here [Formula: see text] denotes an appropriate notion of Stone space of m-types over M. Theorem for unstable case: Suppose that for some positive integer m and for every α μ, K is not i-stable in μ. These results provide a new kind of sufficient condition for the unstable case and shed some light on the spectrum of strictly stable theories in this context. The methods avoid the use of compactness (...) in the theory under study. In this paper, we expound the construction of tree indiscernibles for sentences of Lω1,ω. In Part I of this paper we argued that the first-order systems HP5 and EG are modest complete descriptive axiomatization of most of Euclidean geometry. In this paper we discuss two further modest complete descriptive axiomatizations: Tarksi’s for Cartesian geometry and new systems for adding $$\pi$$. In contrast we find Hilbert’s full second-order system immodest for geometrical purposes but appropriate as a foundation for mathematical analysis.

We provide a general framework for studying the expansion of strongly minimal sets by adding additional relations in the style of Hrushovski. We introduce a notion of separation of quantifiers which is a condition on the class of expansions of finitely generated models for the expanded theory to have a countable ω-saturated model. We apply these results to construct for each sufficiently fast growing finite-to-one function μ from 'primitive extensions' to the natural numbers a theory T μ of an expansion (...) of an algebraically closed field which has Morley rank 2. Finally, we show that if μ is not finite-to-one the theory may not be ω-stable. (shrink)

We introduce the notion T does not omit obstructions. If a stable theory does not admit obstructions then it does not have the finite cover property (nfcp). For any theory T, form a new theory by adding a new unary function symbol and axioms asserting it is an automorphism. The main result of the paper asserts the following: If T is a stable theory, T does not admit obstructions if and only if has a model companion.
